We are experienced in defending clients charged with violent crimes including:
Murder
The killing of another human being is seen as one of the most severe of all criminal charges. Murder is a homicide that is committed with what is known as "malicious aforethought." This means that the criminal act was committed in a calculated move instead of during the heat of the moment.
Manslaughter
Differing from murder, manslaughter is either committed through gross negligence or the actions caused by severe provocation, otherwise known as the "heat of the moment." This is a milder version of homicide and carries milder penalties as a result, but is still a severe charge.
Assault
The criminal act of assault occurs through the threat of causing severe bodily injury to another with the present and clear ability to carry out that threat. This does not necessarily mean that an injury was brought to another person, but rather that the defendant had threatened to do so.
Battery
Unlike assault, which involves both the threatening of causing serious bodily injury, battery is defined as the actual causing of the injury. Should the threat and the causing occur concurrently, they could be charged together, hence the criminal charge known as "assault and battery."
Aggravated Assault
In some cases, should there be aggravated circumstances, the criminal charge of assault can be enhanced to aggravated assault. This could involve the issue of a deadly weapon during the commission of the crime, as well as other factors of the case. This will have harsher penalties.
Armed Robbery
Should you be carrying a deadly or dangerous weapon during the commission of a robbery is considered an armed robbery and is considered to be a serious violent crime. Penalties for this type of crime include both two to nine years of incarceration in a state prison, as well as fines or parole.
Vehicular Manslaughter
Should you cause a fatal car accident, regardless of whether or not there was intention, you could find yourself facing criminal charges of vehicular manslaughter. This is a form of homicide that carries severe penalties and could even be charged as second degree murder if there was malice.
Hate Crimes
Criminal actions that are committed with the element of bias or discrimination are categorized as "hate crimes" by the government. These could be crimes targeting someone based on their gender, sexual orientation, religion or ethnicity and could involve anything from arson to homicide.
